Terms of Service

1. Definitions

  • "Website" means duikbo.at.
  • "Regions" means the Miniduikboot Modded Servers online game regions for Among Us.
  • "Team" means the Miniduikboot Modded Servers operator team.
  • "Service" means the Website, Regions, and all related services provided by the Team.

2. Agreement to Terms

These Terms of Service (the "Terms") govern your access to and use of the Service.

By accessing the Website or connecting to the Regions, you agree to these Terms. If you do not agree, do not use the Service.

3. Changes to Terms

The Team may update these Terms at any time for any reason. We will notify you of changes via:

  • A prominent notice on the Website; or
  • An in-game notification.

Updated Terms take effect 7 days after notice is provided. Your continued use of the Service after this period constitutes acceptance. If you do not agree to the new Terms, stop using the Service.

4. The Service

The Team provides Regions for playing Among Us. You may only use mods that comply with the Among Us Mod Policy (link). You are solely responsible for:

  1. Ensuring your mods are compliant with the Among Us Mod Policy;
  2. Any issues caused by mods (e.g., crashes, bans, or compatibility problems). Some mods may only require installation by individual players but can still affect the shared game experience through network interactions. You are responsible for ensuring your mods do not disrupt, unfairly advantage, or negatively impact other players. The Team is not responsible for any issues arising from such mods, including disputes between players or altered gameplay experiences.

The Team reserves the right to block or restrict mods that violate these Terms or disrupt the Service.

5. Your Responsibilities

You must:

  1. Be old enough to legally consent to these terms and our Privacy Policy under the laws of your country or region.
  2. Secure your account and credentials;
  3. Comply with all applicable laws (including copyright and data protection laws);
  4. Comply with Innersloth's Terms of Service (link);
  5. Follow the Miniduikboot Modded Servers Code of Conduct (link), which prohibits (but is not limited to):
    1. Harassment, hate speech, or discrimination;
    2. Cheating, exploiting bugs, or using unauthorized scripts;
    3. Sharing illegal or harmful content;
    4. Impersonating Team members or other users.
  6. Not circumvent any sanctions imposed by the Team.

6. Sanctions and Enforcement

The Team may impose temporary or permanent bans for violations of these Terms or the Code of Conduct, at its reasonable discretion. Banned users may appeal via the contact page. Circumventing sanctions is prohibited and may result in further action. Sanctions survive updates to these Terms or termination of your access.

The Team reserves the right to monitor activity on the Service to enforce these Terms.

7. Availability and Disclaimers

The Service is provided on a "best effort" basis. The Team does not guarantee:

  1. Uninterrupted, error-free access;
  2. Uptime, performance, or compatibility with all devices, mods or game versions.

8. Privacy

Your privacy is important to us. Our Privacy Policy (link) explains how we collect, use, and store your data. The Privacy Policy is incorporated into these Terms by reference.

9. Termination

These Terms can be terminated:

  1. By You: You may terminate these Terms at any time by ceasing use of the Service and requesting account deletion via the Contact page.
  2. By the Team: The Team may immediately suspend or terminate your access, with or without cause, including for violations of these Terms. No refunds will be provided.

Upon termination, your right to use the Service ends, but sanctions, liabilities, and the Team's rights survive.

10. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied, including (but not limited to):

  1. Merchantability, fitness for a particular purpose, or non-infringement;
  2. That the Service will be uninterrupted, secure, or error-free.

11. Limitation of Liability

To the fullest extent permitted by law, the Team shall not be liable for:

  1. Indirect, incidental, special, or consequential damages, including (but not limited to) loss of data, profits, or goodwill;
  2. Any claims arising from your use of the Service, mods, or third-party content.

Our total liability to you for any claim shall not exceed €100.

12. Indemnification

You agree to indemnify and hold harmless the Team, its members, and affiliates from any claims, damages, or expenses (including attorneys' fees) arising from:

  1. Your violation of these Terms;
  2. Your use of the Service or mods;
  3. Your user-generated content.

13. Intellectual Property

  1. The Team owns all rights, titles, and interests in the Service, including (but not limited to) Software, logos, branding, and documentation.
  2. You may not copy, modify, distribute, or reverse-engineer any part of the Service without prior written permission.
  3. User-generated content (e.g., chat messages, custom game settings, effects created by mods) remains yours, but you grant the Team a worldwide, royalty-free, sublicensable license to use, reproduce, and display it for the purpose of operating the Service.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Netherlands. Any disputes will be resolved in the court district of Oost-Brabant, and you consent to the exclusive jurisdiction of these courts.

15. Miscellaneous

  1. Entire Agreement: These Terms (including the Privacy Policy and Code of Conduct) constitute the entire agreement between you and the Team.
  2. Severability: If any part of these Terms is deemed unlawful or unenforceable, the remainder will remain in effect.
  3. No Waiver: The Team’s failure to enforce any right under these Terms does not constitute a waiver of future enforcement.
  4. Assignment: You may not assign these Terms without the Team’s written consent. The Team may assign these Terms without your consent.
  5. Force Majeure: The Team is not liable for failures caused by events beyond its reasonable control (e.g., natural disasters, strikes, or internet outages).
  6. Donations to the Team are voluntary, non-refundable gifts and do not alter these Terms or create any obligation on the Team’s part.
